Question whether a minor child should be removed from the state by one of the divorced parents who has been awarded custody rests in the discretion of the trial court if there is any evidence sufficient to invoke discretion. 2. Divorce รข€” Order allowing removal of child from state not abuse of discretion. Where a divorced wife who had remarried was obliged to make her Page 345 residence with that of her husband in Colorado, the trial court did not abuse its discretion in authorizing the wife to take the divorced parties minor son, custody of which was awarded to her, with her under the condition to return him to the former husband within 10 days from the beginning of each school vacation at her expense and ordering the former husband to return the child to the wife at least 10 days before the beginning of the school year at his expense. 3. Divorce รข€” Modification of divorce decree not error. Where the divorced wife testified on motion for modification of divorce decree that she was willing to excuse former husband from paying anything for their minor sons support if she was permitted to take him out of the state, the trial court which authorized the divorced wife to take the son out of the state did not err in modifying the divorce decree by relieving the former husband from the necessity of paying for his sons support while the son was staying with the divorced wife.
